1. Acceptance of Terms

By accessing or using the PenaltyWatch application and website (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

PenaltyWatch is a mobile application and website that provides information about Formula 1 steward decisions, penalties, and related racing data. The Service aggregates publicly available information and presents it in an organized, searchable format.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Harass, abuse, or harm other users
  • Use automated systems (bots, scrapers) without our express written permission
  • Impersonate any person or entity

5. Intellectual Property

The Service and its original content, features, and functionality are owned by PenaltyWatch and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Formula 1 Trademarks: This app is unofficial and is not associated in any way with the Formula 1 companies. F1, FORMULA ONE, FORMULA 1, FIA FORMULA ONE WORLD CHAMPIONSHIP, GRAND PRIX and related marks are trademarks of Formula One Licensing B.V. All such trademarks are used for informational and editorial purposes only, with no intention of infringement.

6. User-Generated Content

The Service may allow you to post comments, notes, reactions, or other content ("User Content"). You retain ownership of your User Content, but you grant PenaltyWatch a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate any third-party rights
  • Your User Content complies with these Terms

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

7. Subscription and Payments

Certain features of the Service may be offered as paid subscriptions. By purchasing a subscription, you agree to pay the applicable fees. Subscription fees are non-refundable except as required by law.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or the app store through which you purchased the subscription.

8. Free Trial

We may offer a free trial period for premium features. At the end of the trial period, you will be automatically charged the subscription fee unless you cancel before the trial ends. We reserve the right to modify or cancel free trial offers at any time.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The information provided through the Service is accurate, complete, or current
  • Any defects or errors will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENALTYWATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

11. Indemnification

You agree to indemnify, defend, and hold harmless PenaltyWatch, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Copyright Complaints

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please send a notice of copyright infringement to:

Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed

The Service may contain links to third-party websites or services that are not owned or controlled by PenaltyWatch. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that PenaltyWatch shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party content or services.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or through the account settings in the app.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PenaltyWatch operates, without regard to its conflict of law provisions.

18. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, except where prohibited by law.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PenaltyWatch regarding the Service and supersede all prior agreements and understandings.
